Terms & conditions
Article 1 — Definitions
In these Terms and Conditions, the following terms have the following meaning:
- Trader: Spelen bij Beelen B.V., having its registered office in Amsterdam, registered in the Chamber of Commerce trade register under number 42054928, VAT identification number NL869500910B01.
- Website: the online ticket platform accessible via tickets.spelenbijbeelen.nl.
- Park: the recreational park Spelen bij Beelen, located at Doklaan 40 in Rotterdam, including all buildings, grounds, attractions and other facilities.
- Ticket: the digital admission document sold via the Website and delivered by email (e-ticket).
- Visitor: any person who is in the Park and/or has purchased a Ticket or for whom a Ticket is used.
- Agreement: the purchase agreement that comes into effect once the Customer has placed an order and payment has been confirmed.
- Customer: the natural or legal person who purchases a Ticket via the Website.
Article 2 — Applicability
These Terms and Conditions apply to every offer from the Trader and to every Agreement concluded. By purchasing a Ticket, the Customer accepts these Terms and Conditions. The Trader reserves the right to amend these terms; the version in force at the time of purchase applies.
Article 3 — Offer and formation of the agreement
The offer on the Website is without obligation. The Trader cannot be held to an obvious mistake or clerical error. The Agreement comes into effect at the moment the Customer’s payment has been successfully processed and the Trader has electronically confirmed the order. Upon formation, the Customer receives an order confirmation by email containing the e-ticket as an attachment or a link.
Article 4 — Price and payment
All prices stated on the Website are in euros and include the statutory value-added tax (VAT rate: 9%). Additional costs, such as transaction costs, are clearly stated in advance.
Payment is made exclusively via the payment methods offered on the Website. Payment processing is handled by Adyen N.V. in Amsterdam. The Trader has no access to the Customer’s full payment details; these are processed exclusively by Adyen in accordance with the PCI DSS standard.
Article 5 — Delivery and ownership of the Ticket
After successful payment, the Customer receives the e-ticket as soon as possible, but no later than within 30 minutes, at the email address provided. The e-ticket contains a unique barcode or QR code that is scanned at the entrance of the Park. The Customer is responsible for correctly providing the email address. If the e-ticket is not received, the Customer should contact info@spelenbijbeelen.nl.
Tickets remain the property of the Trader at all times and are provided to the Customer on the condition that they are not resold or provided to third parties in any other commercial manner. In the event of a breach of this condition, the Trader is entitled to declare the Ticket invalid, without the holder being entitled to any refund or compensation.
In the event of loss, damage or theft of the Ticket, the Customer is not entitled to a replacement Ticket. The Trader accepts no liability for damage resulting from loss, theft or misuse of Tickets.
Article 6 — Right of withdrawal
The fourteen (14) day right of withdrawal is expressly excluded for the purchase of a Ticket pursuant to Article 6:230p paragraph 1 sub e of the Dutch Civil Code. Tickets are purchased for leisure activities on a specific date; after purchase, the Customer can therefore not claim a refund on the basis of the right of withdrawal.
Article 7 — Cancellation and refund
7.1 Cancellation by the Customer
Because Tickets are linked to a specific opening date of the Park, no refund is given in principle in the event of cancellation by the Customer. The Trader may, solely at its own discretion and in special circumstances, decide to offer a voucher or alternative. The Customer has no enforceable right to this.
If the Customer has mistakenly purchased a Ticket for an incorrect date, time slot or ticket category, the Customer is not entitled to a refund. The date, time slot and ticket category are clearly shown at every step of the ordering process; the Customer is deemed to have checked this information before purchase.
7.2 Cancellation or change by the Trader
If the Park is wholly or partly closed on the day of the purchased Ticket due to force majeure, a safety closure by a competent authority or another unforeseen circumstance beyond the Trader’s control, the Trader will endeavour to inform the Customer as soon as possible and:
- offer a replacement date, or
- refund the purchase amount by the same means as the payment was made.
If the Park has to close due to extreme weather conditions beyond the Trader’s control and the Visitor is already on site, the Visitor must immediately report to the park manager or a designated member of staff at the entrance to have their right to a refund or a replacement date registered. If the Visitor does not report in this manner, they forfeit their right to a refund or compensation.
The Trader is entitled to temporarily close individual attractions or parts of the Park for maintenance or safety inspection without refunding Tickets, provided the Park as a whole remains open.
Article 8 — Admission to the Park
The Ticket grants one-time admission to the Park on the date stated on the Ticket, within the applicable opening hours. Upon leaving the Park, the right to re-entry lapses. The Customer must show the Ticket at the first request of the Trader’s staff. The Customer is not permitted to resell Tickets at a price higher than the purchase price, nor to use Tickets for commercial purposes.
Children under 14 years of age must be accompanied by a person of at least 18 years of age. Accompanying persons are responsible and liable for the acts and omissions of the children they accompany.
The Trader reserves the right to refuse a Visitor admission or to remove them in the event of a breach of these Terms or the House Rules, without any right to a refund.
Article 9 — House Rules
The Visitor must comply with the House Rules published on the Park’s website and indicated at the entrance. The House Rules form part of these Terms and Conditions. In particular, the Visitor is not permitted to:
- smoke or use e-cigarettes outside the designated smoking areas;
- use or carry drugs or other prohibited substances;
- bring dangerous objects or substances into the Park;
- wear offensive clothing or display offensive behaviour;
- harass, hinder or harm other Visitors or staff;
- carry out commercial or promotional activities without permission;
- resell goods to other Visitors within the Park.
Visitors must follow the instructions of the Trader’s staff. Camera surveillance is in place in and around the Park. The camera footage is retained in accordance with the Privacy Statement.
Article 10 — Attractions, play equipment and separate locations
10.1 Attractions in the Park
The Trader endeavours to keep all attractions and play equipment in the Park available as much as possible, but does not guarantee that all parts are in operation at all times. Which attractions the Park comprises follows from the offering on the Website. Use of the attractions is at your own risk. Age, height or health restrictions may apply to the use of specific attractions; the Visitor must strictly comply with these.
10.2 Separate locations outside the Park
The Trader also operates locations outside the Park that are accessible only with their own, separate Ticket. Which locations these are follows from the offering on the Website. For these locations:
- a Ticket for the Park gives NO access to a separate location, and a Ticket for a separate location gives NO access to the Park;
- the location has its own opening hours and its own time slots, shown on the Website before purchase;
- the Ticket gives one-time access to the location it was bought for, on the stated date and within the stated time slot, and is scanned at that location;
- the remaining provisions of these Terms & Conditions apply mutatis mutandis, reading “the Park” as the location concerned — including the right to a refund when that location is closed.
Use of a separate location is likewise at your own risk and may be subject to age, height or health restrictions; the Visitor must strictly comply with these.
Article 11 — Liability
The Trader’s liability for damage to the Customer or Visitor is limited to cases of intent or conscious recklessness on the part of the Trader. The Trader is in no event liable for indirect damage, consequential damage, lost profit or missed savings. The Trader’s liability is at all times limited to the amount the Customer paid for the relevant Ticket.
The Visitor is liable for damage they cause to the property of the Trader or third parties in the Park.
Article 12 — Privacy
The processing of personal data takes place in accordance with the Trader’s Privacy Statement, which can be consulted at tickets.spelenbijbeelen.nl/privacy.
Article 13 — Complaints and dispute resolution
Complaints about the performance of the Agreement must be submitted to the Trader as soon as possible, fully and clearly described, via info@spelenbijbeelen.nl. The Trader will make every effort to answer a complaint within 14 days; if this is not possible, the Customer will receive an acknowledgement of receipt with an expected response time.
The European Commission provides a platform for online dispute resolution (ODR), accessible via ec.europa.eu/consumers/odr. Consumers can use this platform to submit a dispute to an independent body. Our email address for this platform is info@spelenbijbeelen.nl.
Dutch law applies to this Agreement. Disputes are submitted exclusively to the competent court in the Customer’s place of residence, unless mandatory law designates another court.
